18. Arbitration Agreement

Please review this section carefully—it materially affects your legal rights, including your right to pursue claims in court.

Agreement to Arbitrate

Any dispute, claim, or disagreement between you and UniversityLegalForms.com arising from or relating to these Terms, the Site, the Services, or any Form obtained through the Site shall be resolved through binding individual arbitration rather than in court, provided that either party may assert individual claims in small claims court if such claims qualify for that court’s jurisdiction.

This arbitration provision is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1-16.

Arbitration Procedures

Arbitration proceedings will be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect and shall be conducted before a single neutral arbitrator.

Proceedings may be conducted by telephone, video conference, written submission, or in person, as permitted under the applicable arbitration rules.

Individual Claims Only

All arbitration must proceed on an individual basis only. Neither party may participate in any class, collective, consolidated, or representative proceeding.

Waiver of Jury Trial

By agreeing to these Terms, both you and UniversityLegalForms.com waive the right to have any dispute relating to these Terms or the Services decided by a jury.

Intellectual Property and Injunctive Relief

This arbitration provision does not prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for claims related to intellectual property rights.

19. Governing Law

These Terms shall be interpreted and enforced in accordance with the laws of the State of Arkansas, without regard to its conflict of laws principles.

20. Venue

Any legal proceeding arising from or related to these Terms or the Services that is not subject to arbitration shall be brought exclusively in the state or federal courts serving Benton County, Arkansas. You and UniversityLegalForms.com each consent to personal jurisdiction and venue in such courts and waive any objection to venue or jurisdiction being laid there.

21. General Provisions

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Our failure to enforce any right or provision of these Terms at any time shall not constitute a waiver of that right or provision.
